TOBACCO USE PROHIBITED ON PUBLIC SCHOOL GROUNDS
ADMINISTRATIVE PROCEDURES
NOTIFICATION
The South Burlington School District’s policy on tobacco products will be included in the student, parent/guardian, and employee handbooks.
RESPONDING TO A VIOLATION OF THE POLICY ON TOBACCO PROHIBITION
Upon determination that a student has violated this policy:
1) Students in possession of any tobacco product shall be reported to the principal or his/her designee who shall confiscate the tobacco immediately. If the student is under the age of 18 a referral shall be made to the School Resource Officer. The principal or his/her designee in a manner to render them unusable shall destroy any confiscated tobacco products.
2) The student shall be referred to a qualified person for discussion about the health effects of using tobacco products and legal consequences for possession, use, or transmittal of such products.
3) The student, under the age of 18, shall be cited by the School Resource Officer, which may result in a fine consistent with Vermont Civil Law.
4) School disciplinary procedures shall be followed, which may result in additional consequences and/or legal action.
Employees who violate this policy will be subject to disciplinary procedures and consequences in accord with applicable employee policies, employment contracts, and requirements of law.
Others who use tobacco on school grounds will be informed of this policy and asked to comply. A person failing to comply will be directed to leave school property. A person who refuses to comply or to leave school grounds under this policy will be referred to law enforcement officials to take appropriate action.
